Consideration of an Ordinance of the City of Vernonia Amending Title 9 Chapter 9-01
When: You are invited to attend and comment at the City Council meeting on Monday, August 3, 2020 at 7:00 pm.

Why: The Vernonia City Council is interested in hearing from citizens who are interested in expressing their opinion on the Ordinance.
NOTICE IS HEREBY GIVEN that the Vernonia City Council will deliberate the adoption of Ordinance 924: An Ordinance of the City of Vernonia Amending Title 9 Chapter 9-01.A copy of the Ordinance is available for inspection at Vernonia City Hall located at 1001 Bridge Street, and on the city website: www.vernonia-or.gov.
This Public Notice will also be onsite at City Hall and on www.vernonia-or.gov
ORDINANCE No. 924
AN ORDINANCE OF THE CITY OF VERNONIA AMENDING
TITLE 9 CHAPTER 9-01
The City of Vernonia Ordains:
WHEREAS, in July of 2020 applicant Troy Thomas requested revisions to Title 9 to revisethe permitted uses in the General Commercial Zone, 9-01.03-40.B, Conditional Uses Permitted, subsection 6.Currently residential uses are only allowed as a conditional use when located over a permitted business.The applicant proposed to change this to allow residential uses on the ground floor with a permitted business, as long as the residential use has a separate dedicated entrance; and,
WHEREAS,the City Council is entrusted by the development code to make decisions on legislative matters that require application of high levels of discretion; and,
WHEREAS, the Planning Commission held a hearing on June 16, 2020 in the Council Chambers of City Hall regarding File PA 20-02 the proposed revisions of Title 9 and made a recommendation of approval as modified by the Commission in accordance with Title 9 Section 9-01.09 Text Amendments; and,
WHEREAS,the City of Vernonia City Council held a public hearing on June 20, 2020, in the Council Chambers of City Hall to consider the revisions to Title 9 Sections 9-01 General Commercial Zone, 9-01.03-40.B, Conditional Uses Permitted, subsection 6; and,
WHEREAS,no objections were filed with the City Recorder, but all comments were heard and considered at the public hearings; and,
WHEREAS,one support letter from the Fair Housing Council of Oregon was filed prior to the City Council Hearing and fully considered during the hearing process; and,
WHEREAS,the Vernonia City Council upon consideration of all testimony, comments, the staff reports and findings for File PA 20-02, determined the amendments to Title 9 Chapters 9-01, General Commercial Zone, 9-01.03-40.B, Conditional Uses Permitted, subsection 6 of the Vernonia Municipal Code are appropriate and necessary to better achieve the goals and policies of the City’s Comprehensive Plan and State requirements;
NOW THEREFORE,the City Council of Vernonia does ordain as follows:
Section 1.The City does herby adopt the amendments to Title 9 Chapters 9-01, General Commercial Zone, 9-01.03-40.B, Conditional Uses Permitted, subsection 6, according to the text as shown in Section 3 below; and,
Section 2: Under the provisions of the City of Vernonia Charter of 1998, Chapter VIII, this ordinance may take effect in 30 days from the date of decision; and,
Section 3: Title 9 Chapters 9-01, General Commercial Zone, 9-01.03-40.B, Conditional Uses Permitted, subsection 6 is hereby amended to read:
6. Single and multi-family dwelling units having separate dedicated entry of any permitted use as set forth in Section 9-01.03-40.A above, where no more than 49% of the total square footage, or as approved by the Planning Commission, is used for residential uses.
Section 4 Council Clerk’s Duties:The Council Clerk is hereby directed, upon its adoption and authentication, to number this Ordinance as the next adopted ordinance of the City of Vernonia.
